Cooperate with the HA in handling the complaint, unless there are indications that HA is not responsible for your acts. Our policy will still indemnify you even if no indemnity is available from HA.
We suggest that you still divert the complaint to the HA. If the patient makes a complaint to the regulatory bodies and your employer does not respond or assist then we will appoint lawyers to prepare replies to these bodies.
MPPS is an insurance policy, therefore, all benefits are paid in accordance to the terms and conditions stipulated in the policy provisions at the start of your contract.
By virtue of part 2 in the master policy, MPPS will cover all legal costs for our members to obtain legal advice and legal representations in all of the above four occasions.
Claims-made basis means that the coverage is effective if the policy is in force both when the incident occurs and when the claim is made. Occurrence basis only requires the policy is in force when the incident occurs.
Yes. Like most commercial liability insurance, MPPS is a claims-made basis insurance. We agreed to cover those “insured cases” even when the insured doctor ceased to be a Practicing Member of the Association, with a condition that he/she had continuously been insured for five or more years, or paid the premium equal to five years or above. We also cover doctors who have gone private and insured with our MPPS private scheme.
To establish a case, the claimant must prove on a balance of probabilities that;
- The treating doctor owed the claimant a duty of care
- There was a breach of that duty by the doctor
- The injury or damage suffered was due to breach of duty
Under the common law, the time limit is up to 3 years from the occurrence of the medical mishap for general cases. For cases involving minors, the time limit is the number of years until he/she reaches age 18 plus an additional 3 years. For cases involving adults without mental capacity, there is no limit.
